Rising in the Polls, Kamala Harris Has a Distinguished Career of Serving Injustice

Kamala Harris appealed death penalty rulingAfter a federal judge ruled in 2014 that California’s death penalty system had become so dysfunctional it “violate[d] the Eighth Amendment’s prohibition against cruel and unusual punishment,” Harris appealed the decision. As a result, California’s death penalty was upheld and remains in place today.

Harris refused DNA testing that could exonerate Kevin Cooper, a likely innocent man on death row, and she opposed statewide body-worn police cameras. Harris favored criminalizing truancy, raising cash bail fees and keeping prisoners locked up for cheap labor. She also supported reporting arrested undocumented juveniles to Immigration and Customs Enforcement, covering for corrupt police lab technicians and blocking gender confirmation surgery for a transgender prisoner. A U.S. District Court judge concluded that withholding the surgery constituted cruel and unusual punishment in violation of the Eighth Amendment. More…

CPB agents becoming increasingly aggresiveI should have kept my mouth shut about the guacamole; that made things worse for me. Otherwise, what I’m about to describe could happen to any American who travels internationally. It happened 33,295 times last year.

My work as a journalist has taken me to many foreign countries, including frequent trips to Mexico. On May 13, I was returning to the U.S. from Mexico City when, passing through immigration at the Austin airport, I was pulled out of line for “secondary screening,” a quasi-custodial law enforcement process that takes place in the Homeland Security zone of the airport.

We passed through a detention area harshly illuminated by fluorescent lights where armed CBP officers in dark uniforms outnumbered the few tired-looking travelers. The officers all had Homeland Security patches on their shoulders and pistols on their belts. Moncivias sat me down in a side room with a desk, two chairs, and a microscope on a filing cabinet. The Customs and Border Patrol (CBP) are becoming more and more aggresive. The targets started out being migrants and supposed terrorists. However as usually happens with unchecked power, it turned against other Americans as well.

The next time someone cheers or approves of abuses by CBP or any other police agency, think about how that abuse could be turned against you and those you love.

University of Chicao hospitalsA former University of Chicago medical patient filed a class-action lawsuit against the University of Chicago and Google, claiming that the University of Chicago Medical Center is giving private patient information to the tech giant without patients’ consent.

Dinerstein’s lawsuit claims that EHRs contain patient information ranging from height and weight to diseases they carry such as AIDS or diabetes and medical procedures they have undergone.

The medical records include the demographics of patients, along with their diagnoses, prescribed medicine, and past procedures, the lawsuit alleges. According to the Department of Health and Human Services, HIPAA protects patients’ “individually identifiable health information,” which includes “demographic data, that relates to…the individual’s past, present or future physical or mental health or condition, the provision of health care to the individual, or the past, present, or future payment for the provision of health care to the individual.” More…

Israel has rejected the single state solution. Israel claims it supports a 2 state solution.

broken healthcareLate last year I met Dr. Marty Makary, a renowned surgeon and professor of Public Health at Johns Hopkins University. Marty told me about the research he was doing. That research was published this week in JAMA which talks about the incredible problem of hospitals suing patients—primarily poor and lower middleclass patients, for unpaid medical debt that they can never come close to paying because of the absurdly high prices for which they are being billed.

One of the hospitals Marty and his research team focused on was Mary Washington Hospital in Fredericksburg, VA, which sues on the order of 100 patients every month.

After learning of Marty’s work, Broken Healthcare joined the research team, identified patients, and hired a local attorney to create a pseudo public defender model. The result has been that every time (100%) that we provided a legal defense for a patient, the hospital dropped its law suit. More…

liberty and justice for all, maybeA federal appeals court dismissed a civil-rights lawsuit filed against a Georgia deputy who tried to shoot a family’s dog, but instead hit a 10-year-old boy lying down on the ground. Instead of having to face a $2 million lawsuit for excessive force, Coffee County Deputy Sheriff Michael Vickers was entitled to “qualified immunity” for his actions and cannot be sued in federal court, the Eleventh U.S. Circuit Court of Appeals ruled last week.

Starting in the 1980s, the U.S. Supreme Court began to radically re-shape its doctrine of qualified immunity, creating an escape hatch that lets government officials dodge federal civil-rights lawsuits. As the Supreme Court once put it, qualified immunity “provides ample protection to all but the plainly incompetent or those who knowingly violate the law.” More…

The US judicial system has extended a blanket of impunity over police officer involved shootings, regardless of whether the shootings were justified or not. Now the numbers of fatal shootings by police in US has risen dramatically.

Reflect On:
How safe can people feel when police involved in shootings investigate themselves, have prosecutors protect them by dropping charges, and judges that arbitrarily dismiss cases? Add to this the recent militarization of police forces and the current trajectory, how will this all end?

shoots unarmed victim, claims PTSDPhilip Brailsford is a former Arizona Police officer who was acquitted for the murder of an innocent man in 2017. Brailsford walked free even though body camera footage clearly showed that he had no reason to fire his weapon, ultimately murdering Daniel Shaver.

Now, to add insult to injury, the officer was temporarily rehired by the city in order to receive disability. Brailsford was approved for medical retirement after claiming that killing a man gave him PTSD. He will now receive over $2,500 per month for the rest of his life. The city of Mesa has also agreed to spend up to $3 million defending him in court and paying lawsuit settlements resulting from the murder. More…

The Facts:
The city if Mesa spent millions defending him, and no one else seems to be paying for this crime.

Reflect On:
Who hired this cop? Who hired the guy that hired this cop? Who trained and supervised this cop? Who are the Mesa politicians willing to pay such huge sums to protect Brailsford? Will the money to pay for defense costs and civil suit costs come from the general budget or from the police budget? What are the incentives are in place for Mesa Police to make sure this is never repeated?

police Did you know that when you’re stopped for no reason at a drunk driving checkpoint – well, stopped for no reason having anything to do with something you did to suggest you might be “drunk” – your refusal to participate in self-incrimination can result in your arrest, loss of your government permission slip to travel as well as the impounding of your car?

Your “cooperation” is not only appreciated – it is required.

This not-much-discussed aspect of Checkpoint USA is arguably even worse than the existence of Checkpoint USA – which came into being in the ’80s, when the government decided to re-interpret the limits of its own authority (a problem with government) by summarily decreeing it to be “reasonable” to randomly and arbitrarily stop people and treat them as presumptively guilty of having committed a crime. It is obvious that the US government is destroying Assange to signal to journalists the consequences of publishing information. It is therefore also obvious that any journalist who fails to use whatever platform they have to speak out against Assange’s persecution has no intention of ever publishing anything that the US government doesn’t want published. Their silence on or support for what is being done to this man can and should be taken as an admission that they are nothing other than state propagandists.
